Terms and conditions.

The formal basis for a purchase at House of Vinterberg. Written in accordance with Danish sale-of-goods law, the consumer contracts act and the product liability act.

Prices and payment

All prices are in Danish kroner and include 25% VAT. We reserve the right for typographical errors and minor colour deviations in product images.

Prepayment and card reservation

Stock items are charged at dispatch. Made-to-measure products may require full or partial prepayment, agreed at order. If the amount is reserved on a credit card, it affects your available balance until the item ships.

Late payment

Bank transfer must be made within three days of order confirmation. Late payments accrue interest per started month under Danish interest law (currently the National Bank's lending rate plus 8 percentage points). Missing payment is considered material breach.

Card transactions are processed by our authorised payment provider Frisbii. Card details are transmitted via SSL encryption and never stored by us.

Delivery and pickup

We ship with GLS, PostNord or equivalent recognised carriers. You can also pick up in the showroom. Tracking is included.

Transfer of risk

Risk for the item passes to you as the customer when it is delivered or picked up.

International delivery

For delivery outside Denmark, write to info@houseofvinterberg.com before ordering. Customs, import duties and local fees are borne by the customer.

Delays caused by external carriers, shipping companies or customs authorities are beyond our control, and we cannot be held responsible for them.

Cancellation and returns

Stock items. 14-day right of withdrawal

As a consumer, you have a 14-day right of withdrawal on standard items such as accessories and stocked pieces. The item must be unused and in original condition. You bear the return shipping unless otherwise agreed.

Made-to-measure products. No right of withdrawal

Made-to-measure products (suits, shirts, coats and similar made to your measurements) are excluded from the right of withdrawal under the EU Consumer Contracts Act because they are produced specifically for you. If colour, pattern or fit deviates from what was agreed, we exchange or alter.

You are liable for diminished value if the item has been used beyond ordinary examination. Refunds are made by bank transfer as soon as we have received and approved the returned item.

Fit guarantee

If a piece doesn't sit right, we fix it. Adjustments are performed by Danish tailors in the showroom and can take up to two weeks extra.

Right of complaint

Two-year right of complaint per Danish sale-of-goods law. Covers manufacturing and material defects under normal use. Doesn't cover damage from incorrect use, ordinary wear, lack of maintenance or alterations by anyone other than us.

Natural wear

Ordinary wear in high-friction areas, e.g. knees, crotch and elbows, is to be expected. It is not a defect and is not covered by the right of complaint.

How to make a complaint

Write to info@houseofvinterberg.com within a reasonable time after discovering the defect. We repair, exchange or issue a credit note. Reasonable shipping for approved cases is covered by us.

Choice of law and venue

The agreement is governed by Danish law. Disputes that cannot be resolved amicably or via the Centre for Complaint Resolution are decided by the Copenhagen City Court as first instance.

Changes and cancellation

Conclusion of the agreement

The agreement enters into force when we have sent an order confirmation, and remains in force until delivery is completed.

Changes to the order

Once production of a made-to-measure product has begun, the order is binding. We attempt to accommodate changes but cannot guarantee it.

Cancellation

Cancellation must be communicated in writing with at least ten business days' notice before production begins. If cancellation occurs after production has started, part of the order may be binding.

Rescission for breach

You may rescind the purchase for material breach if we have not remedied it within a reasonable time after written reminder.

Liability and force majeure

Limitation of liability

We are not liable for indirect losses, including loss of operation, loss of profit or loss of data. Our total liability is limited to 25% of the order amount and cannot exceed DKK 5,000.

We are not liable for losses arising from missing data security during transmission over the internet, beyond what follows from mandatory legislation.

Product liability

Vinterberg Clothing ApS is liable under Danish product liability law. We are not liable for indirect losses unless otherwise required by mandatory legislation.

Force majeure

We are not liable for delays or non-performance due to circumstances beyond our control. Examples: strikes, lockouts, war, fire, natural disasters or public intervention. Force majeure must be communicated within ten business days.

If a delay lasts more than 60 business days, both parties may rescind the agreement without further consequences.

Personal data and updates

Processing of personal data

Personal data is processed confidentially and in accordance with GDPR and Danish data protection law. We do not share data with third parties beyond what is necessary to complete your purchase (e.g. payment provider and shipping company). Data is deleted by default two years after the last purchase.
